The prosecution has sought a 30-year prison sentence for five members of ETA for the murder of Gregorio Ordóñez, a councilman for the Popular Party, which occurred in January 1995 in San Sebastián. According to the prosecution, the accused made the decision to carry out the crime in a "collective and agreed" manner.

The public prosecutor has proposed that two ETA members, who had previously testified against the former leadership of the terrorist group, be called as protected witnesses during the trial. Their testimony could help clarify the details surrounding the planning and execution of the murder.
