National Court takes over investigation of Government delegate in Ceuta

The National Court will investigate the Government delegate in Ceuta for his management during the massive influx of migrants in July.

The National Court has decided to take over the investigation related to the Government delegate in Ceuta, Miguel Ángel Pérez Triano. This decision comes after a ruling by Judge María Tardón, who referred the case to the Instruction Court No. 6 of Ceuta to assess whether it should transfer jurisdiction to the National Court.

Judge Tardón finds it appropriate for the complaint against Pérez Triano to be included in the broader proceedings investigating the circumstances of the massive influx of migrants on July 30 and 31. In her ruling, Tardón has requested the Ceuta Court to comment on this matter.

The Ceuta Court has agreed to transfer the investigation to the National Court, aligning with the position of the Public Prosecutor's Office, which argues that it is necessary to investigate the management of the Government delegate in relation to the mass entry. The chief prosecutor of Ceuta, Silvia Rojas, has raised the need to determine if there were significant omissions in preventive measures during those days.

Concerns regarding the actions of the Government delegate focus on whether there was a failure to implement measures that could have mitigated the consequences of the migration crisis. Prosecutor Rojas has requested clarification regarding what information Spanish authorities had before the arrival of the migrants and whether there were failures in prevention.

The National Court must now decide whether to summon Pérez Triano to testify as a defendant after analyzing the complaint filed by the organization Hazte Oír. This decision is part of the process to investigate the responsibilities that may have contributed to the situation that occurred in Ceuta.

The case has garnered attention both in the media and the legal sphere, as it encompasses issues of territorial integrity and crisis management by the authorities. The court seeks to determine the relevant responsibilities in a context of heightened tension due to the massive arrival of migrants.
