New law sets deadline for regime on joint inheritances
A new law has been published giving the Government 180 days to approve a legal regime for joint inheritances, allowing a single heir to sell properties.
The new law, promulgated on August 7 by the President of the Republic, António José Seguro, was published this Monday in the Diário da República. The legislation establishes that the Government will have a period of 180 days to approve a legal regime that allows the sale of properties that are part of joint inheritances.
According to law no. 49/2026, the proposal will enable a single heir to request the sale of real estate that is part of a joint inheritance, simplifying the process and ensuring quicker access to liquidity of assets.
The approval of this legislation received support from the parties that make up the Executive, namely the Socialist Party (PS), the Liberal Initiative (IL), and Juntos Pelo Povo (JPP).
These parties, by supporting the bill, aim to regularize a procedure that has so far posed challenges and deadlocks for heirs in situations of joint inheritances.
The proposed legal regime includes special and urgent processes, which aim to facilitate real estate transactions in these situations, providing a clearer framework for both heirs and potential buyers.
This measure is part of a broader strategy by the Government to modernize and expedite the real estate sector in Portugal, especially concerning the resolution of issues related to inheritances.
