Competition Authority declares inapplicability of Mocoffee acquisition

The Competition Authority determined that Delta's acquisition of Mocoffee does not require prior notification. The regulator issued a statement regarding this decision.

The Competition Authority (AdC) has adopted a decision of inapplicability concerning Delta's acquisition of Mocoffee. According to information released by the AdC, this transaction is not subject to the obligation of prior notification, which exempted the involved companies from any additional formalities.

The Board of Directors of the AdC voted in favor of the inapplicability of the transaction, according to an official statement. The decision was influenced by the understanding that the acquisition does not affect competition in the relevant market.

The AdC is responsible for regulating competition in Portugal and has the authority to assess acquisitions and mergers that may impact the market. In the case of Mocoffee, the analysis concluded that the transaction does not raise significant concerns in this regard.

Mocoffee is known for producing coffee capsules, and Delta is one of the prominent brands in this sector. Therefore, the acquisition could have undergone a more comprehensive analysis had notification been required.

With this decision, the companies can proceed with the transaction without the need for additional evaluation by the Competition Authority, allowing for a faster integration of operations.
