The Federal Police had requested that Alexandre de Moraes, a minister at the Supremo Tribunal Federal, seize Flávio Bolsonaro's (PL-RJ) passport on Sunday, 25 October, citing a "concrete risk" of flight from the country. Moraes ordered the senator to hand over the documents to the Federal Police by 11 a.m. on Tuesday, 27 October. Flávio Bolsonaro, who lost the presidential election, had released a video stating he would not leave Brazil and that he would comply with the order.

The senator failed to appear to surrender his passports within the set deadline. After non-compliance, his documents were cancelled by court order, according to a police source speaking to AFP. The Federal Police informed Argentina of Flávio Bolsonaro's possible flight.

According to Argentine news site Infobae, the senator allegedly left Brazil on the evening of Tuesday, 26 October, on a private flight bound for Argentina with plans to continue to the United States. Family friends confirmed the departure to the United States, according to reports. Flávio Bolsonaro's exact whereabouts remained unknown.

A former campaign coordinator for the senator said he did not know where he was, stating that he had been with him shortly after 4 p.m. on Monday and that they had discussed thanking those who voted for him. The Federal Police continue investigating whether Bolsonaro left the country via the Argentina border.

The investigation in which Flávio Bolsonaro and lawyer Willer Tomaz are subjects involves suspicions of money laundering through an alleged scheme involving the lawyer's companies and betting platforms. The Federal Police had identified elements suggesting possible justification for political persecution as grounds for potential flight.

Meanwhile, earlier reports indicated that Jair Bolsonaro had surrendered his own passports by order of the Supremo Tribunal Federal after being barred from leaving Brazil by Moraes's determination. Bolsonaro had accused President Lula of abuse of economic power and promised to lead the opposition.
